When you buy a product, you do so with the expectation that it will work. That’s only normal. When it doesn’t, it often results in minor frustration as we have to venture back to the store to return and exchange it for a new one or consider the whole purchase a wash. What is a Defective Product?

First and foremost, what exactly is a defective product? Legally speaking, it is any product that is unusually dangerous when used expectedly and as such, causes injury or harm to the person(s) using it. The product can be defective as a result of a design, manufacturing or marketing defect. Determining this is key to understanding who to file a claim against moving forward. 

Who Can I Sue?

There are multiple defendants who may be responsible for the injuries you sustained from a defective product, including the manufacturer, designer and distributor. However, it’s worth noting that you may be able to file a claim against multiple parties. For example, if you were injured by a product that had a design flaw and the retailer failed to recall it in a timely manner, you may be able to sue both the manufacturer and retail distributor for their negligence. 

It’s important to note that you don’t have to be the direct buyer of the defective product in order to pursue a product liability claim. If your neighbor is using a defective lawn mower and a piece of blade flies into your yard and injures you, you can still file a product liability claim and name all parties involved.
