$944,095 Settlement Achieved for Aggravated Spinal Injuries in Dump Truck Rear-End Collision
Diane Connell’s automobile was rear-ended by a dump truck operated by Joseph M. Monaco in the course of his employment with Snowscapes, a snow removal company. She had prior neck and back fusions. Her spinal condition was aggravated by the collision in question. She had 30-plus epidural injections by Dr Michael O’Hara of Woodbridge, NJ, a pain management physician. She had a redo cervical fusion by Dr Nirav Shah of Princeton Brain and Spine. The defendant driver, Joseph M. Monaco, was deemed to be judgment proof, as was his employer, Snowscapes Landscaping. These defendants had a $1 million combined single limit policy with Farm Family, which was reduced for property damage and a purported lien by Personal Injury Protection insurer (PIP), Mercury Insurer. $415,000 Settlement Secured in Underinsured Motorist Claim for 75-Year-Old Plaintiff Following Multiple Surgeries
In this Underinsured Motorists Claim arising out of a July 25, 2022, motor vehicle accident, the Plaintiff, Ahn Nguyen, is 75. He had prior low back surgery and fusion. He previously suffered from a neurological condition that required him to use daily fentanyl patches. He alleged aggravation to his lower back from the 2022 accident, which resulted in two new surgeries. The case was complicated because while he was hospitalized for the first of the two new surgeries, he was dropped from a hospital bed, which disrupted the new surgery and required a redo of the first surgery. He recovered $15,000 from the tortfeasor driver, leaving Underinsured Benefits of $485,000 with New Jersey Manufacturers Insurance. The case was arbitrated for $415,000 in new money and was settled for $400,000 on the eve of trial. Total recovery was $415,000, not including any monies from potential hospital negligence.
