Frequently Asked Questions about Laborer and Landscape Worker Injuries

Can I seek compensation if I was injured while employed as a landscape worker?

If you have suffered an injury while working as a landscape worker, you may be able to recover compensation by seeking workers’ compensation benefits through your employer. You may also be able to seek compensation by pursuing a personal injury claim against the owner of the property on which you were working when you were injured. This is possible if you were injured as a result of dangerous conditions on the owner’s property. If your injuries were the result of defective equipment, you may be able to seek compensation through a product liability claim.

The team at Lombardi and Lombardi, P.A. will identify all possible options for recovering compensation. We will pursue any and all benefits that you are eligible to receive. We will explore all options for compensation to ensure that you maximize your compensation. Contact us today for a free consultation with an experienced attorney from our law firm.

How long do I have to pursue my claim for compensation as a landscape worker?

This depends on which options you are choosing to pursue. If you are pursuing workers’ compensation, you will need to notify your employer as soon as possible. Employers and their insurance providers aren’t always willing to pay workers’ compensation. If your employer or their insurance provider refuses to pay or offers to pay fewer benefits than you feel you are entitled to, you can file a formal claim petition with the New Jersey Division of Workers’ Compensation. However, you will only have two years from the date of the injury to do this.

If you choose to pursue a personal injury claim against a third party such as the manufacturer of defective equipment that caused your injury or the property owner for dangerous conditions on their property, you will have two years from the date of the injury to file a claim.

It is advisable to consult with an experienced New Jersey laborer and landscape worker injury lawyer as soon as possible after your injury. The attorneys at Lombardi and Lombardi, P.A. will help you understand your rights and options. We will explore all options for compensation available to you and guide you in pursuing them to maximize your compensation.
