Paul R. Garelick, Esq. Recovers $9 Million in Two Medical Malpractice Lawsuits

$2.0 Million Settlement – Paralysis Caused by Delayed Diagnosis in Emergency Room

The plaintiff, a 48-year-old experiencing low back pain, went to the emergency room. He had a known history of a herniated disc, which was documented and known to the ER physician. ER physician examines but fails to perform any diagnostic testing. Physician administers two shots for pain, prescribes pain medication, and discharges plaintiff. Plaintiff arrives home late in evening from ER and goes to sleep. Plaintiff wakes up early in the morning unable to walk and can only move two toes on one foot. EMS called to respond to plaintiff’s home. EMS fails to examine plaintiff, who advises he cannot walk, cannot urinate, and can only move two toes on right foot. Plaintiff advised by EMS to take medication and, if problem persists, to call back. Plaintiff calls hospital next day, and no EMS sent and not advised to go to hospital. Plaintiff remains at home several more days continuing on medication until near death, when EMS called again. He is taken to hospital, where it is determined he has a lumbar herniation encroaching on spinal cord that has left him paralyzed. Emergent surgery performed. Plaintiff left paralyzed and wheelchair-bound.

Plaintiff sues ER physician, EMS responders, and hospital. Plaintiff’s counsel was Paul R. Garelick, Esq., of Lombardi and Lombardi, P.A. Plaintiff’s case settles at a settlement conference before the Honorable Kathleen Sheedy for 2 million dollars. As aspects of the settlement involve confidentiality, other details are not available.

$7.75 Million Settlement – Paraplegia Following Spinal Surgery Performed Despite Known Bleeding Disorder

Ahmad, age 39, suffered paraplegia and several residuals as a result of post-surgical hematoma after spinal fusion surgery. The allegation was that the surgeon and anesthesiologist proceeded with spinal surgery despite knowledge that Ahmad had a bleeding disorder and failed to obtain a hematological consult prior to proceeding. Ahmad suffered paraplegia with resultant permanent colostomy and suprapubic catheter. Ahmad is wheelchair-bound.

The settlement was facilitated by retired Judge Kenneth Grispin, and later by Bruce Kaplan, Civil Presiding Judge, Middlesex County Superior Court. Plaintiff was represented by Paul Garelick of Lombardi & Lombardi, Edison, New Jersey. The settlements were in part protected by confidentiality agreements and further details cannot be provided.
